SPL205234_008 Lindsay could be in more trouble than ever. The recently released jailbird reportedly hit a baby with her Maserati, and attorney Raoul Felder says she might have more bars in her future.
Lindsay Lohan, 24, just doesn’t seem to get it. You would think she’d be volunteering and changing her image since being released from both jail AND rehab early, but Linds is clearly too cool for that. The once Hollywood A-lister not only was pulled over Aug. 28 for blowing a stop sign, but she also reportedly hit a baby stroller Sept. 1 — yes, there was a child inside the stroller.

HollywoodLife.com spoke with Raoul Felder, named as one of America’s 100 most powerful lawyers in New York Law Journal, who says Lindsay could be in very serious trouble, even if no police report was filed.

“In Los Angeles the pedestrian always has the right of way,” says Mr. Felder. “Even if it’s a green light and the pedestrian is j-walking they still get the right of way.”

Lindsay might think she’s in the clear since no one reported the incident to the LAPD or LASD [HollywoodLife.com spoke with both departments] but according to Raoul, this actually makes the situation even worse.

“First off, it’s against the law to not report an accident, and that’s an offense within itself and it was Lindsay’s responsibility to do that,” says Raoul. “There are murders that don’t get reported and there are still investigations. If the investigation can prove that she really hit the stroller even if the baby wasn’t hurt, she could lose her license and most likely go back in the cooler. I don’t see how she’s going to walk away from this one when she has a record already.”

Like we’ve said before, Lindsay shouldn’t even be behind the wheel of a car — what is she thinking?!

“I would advise her to not drive cars and treat every day as if she were being photographed,” says Raoul. “I would tell her ‘don’t go near a car and don’t be in a room where anyone is drinking.’”

Raoul is referring to the recent photographs of Lindsay on TMZ that show her in a room with several bottles of alcohol.

“If there’s photos of liquor bottles that’s not going to impress any judge,” says Raoul. “Whatever hope there is for Lindsay is diminishing rapidly and she is clearly unable to help herself.”

Eric Deaton, Tea Party-Backed Ohio Senate Candidate, Indicted For Sex With A Minor

s-ERIC-DEATON-OHIO-TEA-PARTY-large300 Eric Deaton, a Constitution Party candidate running for the seat Sen. George Voinovich (R-Ohio) is vacating (with the help of endorsements from Tea Party and family values groups) has been indicted for unlawful sexual conduct with a minor that he supposedly met at his church.

Deaton responded to the allegations Wednesday, denying charges that he had sexual contact between March 2006 and 2007 with a 15 year old girl that he had first encountered as an elder in his congregation. He also said that he plans to stay in the race despite the timing of the case.

WDTN reports that the Perry Township Police Department believes Deaton tutored the girl and invited her to work around his home. Police also say they have incriminating hotel receipts and surveillance video that will make their case, though Deaton's attorney says this evidence will prove his innocence.

The charge carries a maximum penalty of five years in prison and a fine of up to $10,000. Deaton will fight the charges in court on September 14th.

According to his website, Deaton also likes stamp & coin collecting, firearms, vintage muscle cars and is currently a local Cub Scout leader.

Paris Hilton BANNED From Wynn Resorts

s-PARIS-HILTON-WYNN-BAN-large300 LAS VEGAS — Paris Hilton was banned Wednesday from two Wynn resorts on the Las Vegas Strip, and her boyfriend was dismissed as a nightclub partner following their arrests in a vehicle that police said reeked of marijuana.

Wynn Resorts Ltd. spokeswoman Jennifer Dunne told The Associated Press that Hilton is barred from Wynn Las Vegas and Encore.

Meanwhile, boyfriend Cy Waits was "separated" from his job after less than a week as top managing partner of the Tryst Nightclub at Wynn and XS The Nightclub at Encore, Dunne said in a statement.

Waits and a lawyer and publicist for the 29-year-old Hilton did not immediately respond to requests for comment.

The moves come after Hilton was arrested Friday for investigation of felony cocaine possession. Waits was arrested on suspicion of misdemeanor driving under the influence of alcohol or drugs. Charges have not yet been filed.

Hilton was arrested inside the Wynn resort, where a police lieutenant reported a small plastic bag containing 0.8 grams of cocaine fell into his hand when Hilton reached for a tube of lip balm in a purse.

The celebrity socialite is scheduled for arraignment Oct. 27 and would face probation if convicted.

A police report made public Wednesday said the suspected butt of a marijuana cigarette was found in the Cadillac Escalade in which the couple was stopped in front of the Wynn Las Vegas hotel-casino.

Waits, 34, was driving. He had bloodshot eyes, smelled of alcohol and wobbled as he failed balance and walk-and-turn field sobriety tests, the arresting officer said.

Edward Coyle, Retiree Advocate: No Judge 'Would Allow Alan Simpson To Serve On A Jury If Social Security Were On Trial'

s-CHENEY-CENTER-large300 Opponents of cutting Social Security benefits for retired Americans won't relent in their mission to convince President Obama that Alan Simpson should not lead the president's deficit commission, which may recommend cuts to retirees' benefits.

"There is not a judge in this country that would allow Alan Simpson to serve on a jury if Social Security were on trial," said Edward Coyle, executive director of the Alliance for Retired Americans, in a statement. "Co-chairing a presidential panel is serious business. Much like serving on a jury, it requires a fair, balanced, and honest evaluation of the evidence. By this reasonable yardstick, Alan Simpson has disqualified himself from serving on this commission."

Social Security stands accused of aiding and abetting an unconscionable national budget deficit. The jury is the president's National Commission on Fiscal Responsibility and Reform. Simpson, a former Republican senator from Wyoming, is the co-foreman -- even though he called Social Security "a milk cow with 310 million tits!" last week.

Simpson apologized for the statement and the White House said he would remain co-chairman of the commission despite mounting pressure to ask for his resignation.

"Simpson's remarks were not only deeply hurtful and inaccurate, but they clearly compromise his ability to objectively weigh the arguments presented to the commission during its deliberations,' said Coyle. "His conduct is unbecoming someone trusted with this level of responsibility, and it is time for President Obama to replace him with someone with a greater sense of comportment and impartiality."

Simpson's milk cow remark is the most recent in a series of cranky statements -- he said most of the people anxious about Social Security who write him are "people who live in gated communities and drive their Lexus to the Perkins restaurant to get the AARP discount," for instance.

Social Security's actuaries estimate it can pay out full benefits until 2037.

Eddie Bernice Johnson, Texas Dem Rep., Admits She Steered Black Caucus Scholarships To Family And Friends

s-EDDIE-BERNICE-JOHNSON-large300 WASHINGTON — A Texas congresswoman admitted that she wrongly steered thousands of dollars in college scholarships from the Congressional Black Caucus Foundation to her own relatives and the children of a staff member but said she did so unintentionally.

Democratic Rep. Eddie Bernice Johnson said in a statement Monday that she will reimburse the foundation by the end of the week. She did not state how much money was involved. The Dallas Morning News reported Monday that 23 scholarships she has handed out since 2005 violated the foundation's eligibility rules.

The Morning News reported on its website that Johnson had arranged scholarships between 2005 and 2008 for two grandsons and two grandnephews and the son and daughter of a Dallas-based aide, Rod Givens. The newspaper placed the amount of those scholarships at up to $20,000.

In 2009, according to the foundation, Johnson gave two grandsons and the aide's two children two scholarships apiece from foundation funds, the newspaper reported.

Relatives of members of Congress are ineligible to receive scholarship funds from the foundation because of anti-nepotism rules. The scholarships also violate a foundation rule that recipients need to live or study in the district represented by the Black Caucus member who awards the scholarship.

"As previously stated, I was unaware of being in any type of violation and never intentionally violated the CBCF's rules," Johnson said in a statement sent by e-mail by her office. She said she would appoint a third party to examine her office's practices in distributing scholarship money.

"I have never and never planned to restrict my help to only Texans who reside in my district," she said. "My district lines have constantly changed and since I am the only Democrat in the entire North Texas Region ... much of my district office casework benefits people outside my constituency. While I am not ashamed of helping, I did not intentionally mean to violate any rules in the process."

The Black Caucus Foundation, a nonprofit organization formed by black lawmakers, receives millions of dollars in private corporate sponsorships. The group is best-known for organizing an annual legislative conference in Washington that draws thousands of black leaders around the country. It also runs various programs aimed at getting African-American youths involved in government and politics.

The foundation provides $10,000 a year for members of the Congressional Black Caucus to dispense in scholarships. Members can decide how the money is split and how it is awarded, although the foundation sets some basic rules.

Michele Bachmann's Campaign Boasts Of Her Assault Rifle Prowess: 'Congresswoman Has A Great Shot'

s-MICHELLE-BACHMANN-ASSAULT-RIFLE-large300 Rep. Michele Bachmann (R-Minn.) finished up a campaign tour by shooting off some assault rifle rounds Thursday, a few days before the Congresswoman is set to head off to Glenn Beck's "Restoring Honor" rally in Washington D.C.

While making an appearance at Federal Ammunition ATK in Anoka, Minnesota, Bachmann took to the shooting range with an M4 carbine after shedding her media tail -- CNN reports that journalists were taken aside and only provided information on the visit by the Bachmann campaign after some persistence.

According to CNN:

Two employees said Bachmann fired off several rounds on a semi-automatic (single shot per trigger pull) before switching over to an automatic (multi-shot per pull) for a few minutes. She was shooting at printed human profile targets that, according to the employees, she kept as a souvenir. The employees said they were a little too far away to see how good her aim was.
The Bachmann campaign later gave an account of the congresswoman's appearance by email:

"Congresswoman Bachmann today toured Federal Ammunition ATK, and met with dozens of employees that have worked at the factory for many years," Bachmann spokesman Sergio Gor wrote, according to CNN. "Federal Ammunition ATK is a significant employer in the district and Congresswoman Bachmann considers these jobs very important for the district. Congresswoman Bachmann is a strong supporter of the 2nd Amendment and was able to fire several rounds of bullets produced in this factory. The Congresswoman has a great shot and did well!"

Rep. Bachmann is a well-known gun rights activist, and, according to her original election campaign website, has been shooting firearms since she was 12 years old.

As a United States congresswoman, she co-sponsored legislation to force the District of Columbia to loosen gun registration & trigger lock laws in 2007.

15 Penn Plaza Approved: Empire State Building Skyline Rival Gets OK

NEW YORK — The Empire State Building's owner lost his bid to stop a new skyscraper from rising in the neighborhood when the New York City Council approved zoning and land use changes Wednesday that pave the way for the 1,190-foot tower.

The project, called 15 Penn Plaza, is still in the planning stages. Developer Vornado Realty Trust has not set a date for its construction and has yet to sign a major commercial tenant.

But the plans alone for a glass office tower, which would stand higher than the Empire State Building's 86-floor observatory, infuriated the landmark's owner, Anthony Malkin, so much that he called it an "assault on New York City and its iconography."

Council members voted overwhelmingly in favor of the project. They said New York City and its world-famous skyline cannot afford to be frozen in time and must embrace new investments.

"We can't make decisions based on one building," said Councilman Mark Weprin. "The city has to grow, and it's going to continue to grow."

Mayor Michael Bloomberg also backed the project this week, dismissing Malkin's argument as delusional.

"Anybody that builds a building in New York City changes its skyline – we don't have to run around to every other owner and apologize," he said. "One guy owns a building, he'd like to have it be the only tall building – I'm sorry, that's not the real world."

Plans envision a 67-story, 1,190-foot-tall office tower two blocks west of the Empire State Building, which stands 102 stories and 1,454 feet but has an 86th-floor observation deck about 1,050 feet above ground.

Malkin had lobbied the council to cut the tower by one-third the proposed height.

Lincoln Chafee, Feeling Vindicated By History, Wants Bush Tax Cuts To Expire For Everyone

s-LINCOLN-CHAFEE-large300 Former Sen. Lincoln Chafee (I-R.I.) said on Tuesday that history has vindicated his opposition to the Bush tax cuts and that by the end of the year Congress should let those tax cuts expire both for the wealthy and all Americans.

In an interview with the Huffington Post, the Republican turned Independent politician -- now running for governor of Rhode Island -- scoffed at the arguments made by his former colleagues who are trying to keep the tax rates at their current reduced levels.

"I don't see how anyone could make the argument" that tax cuts for the wealthy will spur economic growth, Chafee said. "Just look at the evidence. When [the tax rates] were put in place in the 90s the economy prospered. When the tax was repealed under Bush, the economy crashed... I know it would be difficult to do, but the evidence would suggest that the wealthy can pay and the economy did rebound when Clinton put that tax policy in place in 1993. It cost him both houses of Congress but the evidence is that economy will benefit."

Asked specifically if Congress should let the entire package of Bush tax cuts expire, including for those making under $250,000, Chafee tried to draw from the pragmatism he saw in Clinton's approach.

"Yeah," he said. "The tax cuts expire and they have been a failure. What could be more of a failure than what we have with our economy right now?"

Among those debating the efficacy of the Bush tax cuts, Chafee occupies a unique place. He was one of only two Republicans to oppose the first package considered in 2001. It was, at the time, a lonely perch inside the GOP tent. Bush had run his campaign on a promise to provide fiscal relief from the top earners on down. Senator Jim Jeffords, then caucusing with Republicans, joined Chafee in opposing the tax cuts on the grounds that they were irresponsible. Once the size of the package was reduced in conference committee, however, the Vermonter switched his tune. Sen. John McCain (R-Ariz.) would ultimately side with Chafee against the package, but as Chafee recalls it, "McCain's vote came out no where."

The final vote, ultimately, was a loss for the Senator but not a complete setback. While the Bush administration got the tax cuts into law they were forced to sunset the package after ten years, both for budgetary and political purposes.

Alan Simpson: Social Security Is 'A Milk Cow With 310 Million Tits'

s-ALAN-SIMPSON-SOCIAL-SECURITY-large300 Alan Simpson believes that Social Security is "like a milk cow with 310 million tits," according to an email he sent to the executive director of National Older Women's League Tuesday morning. Simpson co-chairs the deficit commission, which is considering various proposals to cut Social Security benefits.

Simpson's email, which OWL chief Ashley Carson released publicly, (PDF) was sent in response to an April blog post Carson wrote for the Huffington Post. Carson criticized Simpson for repeatedly describing his Social Security opponents as "Pink Panthers," arguing that the description had sexist connotations.

His email is peppered with exclamation points and condescension. At one point he urged Carson to read a certain graph, "which I hope you are able to discern if you are any good at reading graphs."

Simpson concludes by implying that leading a major organization dedicated to the interests of middle-aged and elderly women is not "honest work."

"If you have some better suggestions about how to stabilize Social Security instead of just babbling into the vapors, let me know," he writes. "And yes, I've made some plenty smart cracks about people on Social Security who milk it to the last degree. You know 'em too. It's the same with any system in America. We've reached a point now where it's like a milk cow
with 310 million tits! Call when you get honest work!"
